There are two different types of CBD oil products — hemp-based CBD oil and marijuana-based CBD. Industrial hemp and marijuana may come from the same Cannabis Sativa plant but they have a drastically different genetic profile. Industrial hemp is an exclusive strain of Cannabis Sativa. Marijuana, on the other hand, can be Cannabis Sativa, Cannabis Indica, or Cannabis Ruderalis.
The key difference is in the parts of the plant extracted to make the product. Industrial hemp has long and strong natural fibers while marijuana is full of flowering buds. Modern technology has allowed American growers to produce industrial hemp with more flowers and higher yields of cannabinoids.
Marijuana-based CBD contains high amounts of THC with very low CBD. Hemp-based CBD oil naturally has a very high amount of CBD and only trace amounts of THC.
In the United States, Section 7606 of the Agricultural Appropriations Act of 2014 considers industrial hemp as legal only if it contains less than 0.3% of delta-9 tetrahydrocannabinol (THC) per dry unit.

Full spectrum CBD does contain trace amounts of Tetrahydrocannabinol (THC) but in very low concentrations (less than 0.3%).
